These Terms of Service (the “Terms”) govern your use of the Neverchase website, online store, digital products, memberships, content, and related services (collectively, the “Services”). 2. Eligibility and accounts
You must be at least 18 years old, or the age of majority where you live, to purchase a product or subscribe to a membership. By using the Services, you confirm that the information you provide is accurate and that you are legally able to enter into this agreement.
Some Services may require an account. You are responsible for keeping your login information confidential and for all activity under your account. Notify us promptly at [Insert support email] if you believe your account has been accessed without authorization.
3. Products and digital content
Neverchase may sell digital guides, workbooks, courses, audio content, downloads, community access, and other products. Product descriptions, images, availability, and pricing may change without notice. We make reasonable efforts to describe products accurately, but minor differences may occur between promotional materials and the delivered product.
Digital content is licensed to you for your personal, non-exclusive, non-transferable use. Unless we give you written permission, you may not copy, resell, redistribute, publish, upload, share, sublicense, modify for commercial use, or create derivative products from any Neverchase content.
You may print or download content for your own personal use where the product format permits it. You may not share your access credentials or allow another person to access paid content through your account.
4. Inner Circle membership
The Neverchase Inner Circle is a recurring membership unless the checkout page clearly states otherwise. The applicable price, billing interval, trial period, and renewal terms are shown at checkout.
By starting a recurring membership, you authorize our payment processor and Shopify to charge the selected payment method at the beginning of each billing period until you cancel. Memberships renew automatically unless cancelled before the next renewal date.
You may cancel your membership through your account dashboard, through the cancellation method shown at checkout, or by contacting [Insert support email]. Cancellation stops future renewals. Unless the Refund Policy or applicable law provides otherwise, cancellation does not automatically create a refund for a billing period that has already begun.
We may change membership features, content, community formats, or pricing. If a price change affects a future renewal, we will provide notice where required by law. You may cancel before the change takes effect.
We may suspend or terminate access for non-payment, misuse of the community, breach of these Terms, harassment, unlawful conduct, or conduct that risks the safety or privacy of members. Where appropriate, we may provide notice and an opportunity to address the issue.
5. Community standards
If you participate in a Neverchase community, you agree to communicate respectfully and protect the privacy of other members. You must not harass, threaten, impersonate, dox, discriminate against, or target another person. You must not post unlawful, defamatory, sexually exploitative, hateful, or intentionally harmful material.
Do not share another member’s name, messages, images, personal circumstances, or identifying information outside the community without that member’s permission. We may remove content or restrict access when reasonably necessary to protect members or operate the community.
6. Educational information and no professional advice
Neverchase content is for general educational and personal-development purposes. It is not medical, psychological, mental-health, legal, financial, or other professional advice. It is not a substitute for a qualified professional who understands your circumstances.
Relationship and personal-development outcomes vary. We do not guarantee that a product, membership, communication approach, or exercise will produce a particular result, change another person’s behavior, or create a particular relationship outcome. Use your judgment and seek professional help when appropriate.
If you are in immediate danger, experiencing abuse, or facing a mental-health emergency, contact local emergency services or an appropriate qualified support organization.
7. Orders, prices, and payments
Prices are shown in the currency displayed at checkout and may exclude taxes, duties, or payment-processing charges where applicable. You authorize Shopify and its payment providers to process your payment for the total shown at checkout.
We may refuse, limit, or cancel an order where permitted by law, including where a product is unavailable, a pricing or listing error occurred, payment cannot be verified, or we reasonably suspect fraud or misuse. If we cancel an order after payment, we will refund the amount paid for the cancelled portion.
You are responsible for providing current billing and contact information. We are not responsible for delays caused by inaccurate information, payment-provider failures, or events outside our reasonable control.
8. Intellectual property
The Services and their content, including names, logos, text, graphics, designs, videos, audio, downloads, layouts, and software, are owned by or licensed to Neverchase and are protected by applicable intellectual-property laws.
These Terms do not transfer ownership of any Neverchase intellectual property to you. We grant you only the limited personal-use license expressly described in these Terms or at checkout.
9. User content and feedback
If you submit a review, testimonial, question, suggestion, or other material to us, you confirm that you have the right to submit it and that it does not violate another person’s rights. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, edit, publish, and display that material for operating and marketing the Services, subject to applicable law and our Privacy Policy.
Do not submit confidential or sensitive personal information that you do not want us to receive.
10. Third-party services and links
The Services may use or link to third-party platforms, including Shopify, payment processors, email providers, community platforms, and social networks. Third-party services are governed by their own terms and policies. We are not responsible for third-party services that we do not control.
11. Disclaimers
To the maximum extent permitted by law, the Services are provided on an “as available” and “as is” basis. We do not promise that the Services will always be uninterrupted, secure, error-free, or available at every location.
Nothing in these Terms excludes or limits a right or remedy that cannot lawfully be excluded or limited. Where a limitation is not permitted, it applies only to the maximum extent permitted by applicable law.
12. Limitation of liability
To the maximum extent permitted by law, Neverchase and its owners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive losses, or for loss of profits, revenue, data, goodwill, or expected savings arising from or related to the Services.
To the maximum extent permitted by law, our total liability for claims arising from the Services will not exceed the amount you paid to us for the specific product or membership giving rise to the claim during the twelve months before the event giving rise to the claim.
13. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Neverchase and its owners, officers, employees, contractors, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from your breach of these Terms, misuse of the Services, violation of law, or violation of another person’s rights.
14. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Your continued use of the Services after an update means that you accept the updated Terms, except where applicable law requires another form of consent.
15. Governing law and disputes
These Terms are governed by the laws of Wyoming, without regard to conflict-of-law rules, unless applicable law gives you the right to proceed elsewhere.
